Shippers Recite List of Questionable Conclusions Espoused in FERC's Opinion on Initial Decision Addressing the Market Power of ANR Storage; Presiding Judge Blasts Commission's 'Mistake' In Allowing a Procedurally Tainted Outcome That Could Have Implication for Both Gas and Electric Case Hearings
The Canadian Association of Petroleum Producers (CAPP), Northern States Power Co.-Minnesota and Northern States Power Co.-Wisconsin (jointly, NSP), Tenaska Gas Storage, LLC, and BP Canada Energy Marketing Corp., -- collectively, the Joint Intervenor Group (JIG) - requested clarification and rehearing of the Commission's order on Initial Decision ((D) (Opinion No. 538) issued 10/15/15 with regard to the disposition of the market-based rate flexibility sought by ANR Storage Co. (ANRS) (RP12-479). Opinion 538 concerned ANR S'’s request for a declaratory order granting authorization to charge market-based rates for natural gas storage service. (ANR Storage also submitted a petition for rehearing of Opinion 538. Its petition, dated 11/13/15, will be reviewed in next week's published FR, which will be issued on Wednesday, before Thanksgiving Day.)
