The claimant in this case was a supporter of the organisation,Talk Fracking,which campaigns on the dangers the industry poses to the environment.The Claimant challenged the adoption of the new paragraph 209(a)of the NPPF which was based on a Written Ministerial Statement(WMS)entitled”Shale Gas and Oil Policy”published first in 2015 and then revised before the final NPPF was published.The WMS was copied out under the heading”Oil,gas and coal exploration and extraction”at paragraph 209(a)of the new NPPF:”209.Minerals planning authorities should: a)recognise the benefits of on-shore oil and gas development,including unconventional hydrocarbons,for the security of energy supplies and supporting the transition to a low-carbon economy;and put in place policies to facilitate their exploration and extraction.”
