CSX, utility CMS reach new coal rail rate deal

US utility CMS Energy and eastern railroad CSX have agreed to a new coal delivery contract, setting aside a legal fight over rates. The new agreement ends the rate complaint CMS’ Consumers Energy subsidiary has pursued at the Surface Transportation Board (STB). The companies, in a 28 January petition to the STB seeking to end the challenge, said they had “reached a complete and final commercial settlement of all matters at issue.” The 2015 complaint is the only rate case before the board.
