STB review of DM&E's PRB expansion upheld in federal appeals court

A US appeals court has upheld the Surface Transportation Board's environmental review of the Dakota, Minnesota and Eastern Railroad's proposed expansion into the Powder River Basin coalfields, clearing a significant hurdle to the project. In an announcement issued late December 28, STB Chairman Charles Nottingham applauded the decision reached on the same day by the US Court of Appeals for the Eighth Circuit in St. Louis that rejected arguments made by the Mayo Clinic and other project opponents calling for a new environmental review of the project (PCT 11/15).
