EPA seeks day in court on boiler MACt challenge

The Environmental Protection Agency wants to argue its case in court regarding a challenge of its stay of rules limiting hazardous air pollutants from industrial boilers. In July, Earthjustice, on behalf of the Sierra Club, chal- lenged in the US District Court for the District of Columbia EPA’s administrative stay of its National Emission Standards for Hazardous Air Pollutants for new and existing major industrial sources such as refineries, requiring the use of maximum achievable control technology.
