Peak pursues claim against Anker over Mt. Storm plant

Peak Coal Sales, based out of Somerset, Pa., wants Anker Coal Group's bankruptcy judge to give it an extended deadline to pursue a claim against Anker over a coal contract to supply Dominion Virginia Power's (formerly VEPCO) Mt. Storm power plant. Judge Edward Friend, out of the bankruptcy court in Northern West Virginia, had set a March 17 "bar date" for anybody with a claim against Anker to file with the court. But in a March 26 filing, Peak's attorneys said the company was never notified of Anker's Chapter 11 filing or of the bar date and only found out on March 24. So it has asked the court for an extended deadline. An April 22 telephone hearing has been set.
