For the better part of 2009 and 2010, the fear of many employers and their advocates was that Congress was going to pass the Employee Free Choice Act (EFCA). In a nutshell, the EFCA would have significantly changed the way in which unions organize employees by mandating card-check recognition. Currently, the process of choosing to unionize involves a 45-day campaign, during which time the union and the employer— within certain limits—are able to advocate for their respective positions. At the conclusion of that campaign period, there is a secret vote by all eligible employees to approve or decline union representation.
