It was October 20,2011, a big day for Don Berwick and his team at the Centers for Medicare and Medicaid Services (CMS) in Washington, D.C., and a month before he announced his long-anticipated departure from the agency. They were unveiling the Final Rule for the Medicare Shared Savings Program-the blueprint for a key type of new accountable care organization (ACO) created under the Affordable Care Act of 2010 to provide better, more seamless, and less expensive health care.The preliminary regulation released in March 2011 had been savaged by many in health care who raised objections to everything from its prescriptiveness to the perceived meager finan-cial rewards for providers that became ACOs. Since then, CMS administrator Berwick and his staff reviewed a1,300 comments and painstakingly crafted a revised rule that they hoped would get a far better reception.
