The proposed exemption from safety legislation for the self-employed has been revised so that all self-employed will not have to comply with the HSWA unless they appear on a prescribed list. Originally there was to be an HSE list of exemptions. The House of Commons Deregulation Bill Committee looking at the proposed amendment to Section 3(2) of the HSWA (under the Deregulation Bill) has voted for a new wording, which would read (amendments in square brackets): "It shall be the duty of every self-employed person [who conducts an undertaking of a prescribed description] to conduct [the] undertaking in such a way as to ensure, so far as is reasonably practicable, that he and other persons (not being his employees) who may be affected thereby are not thereby exposed to risks to their health or safety."
