In a decision released November 21, National Labor Relations Administrative Law Judge (ALJ) Paul Bogas ruled that Massey Energy discriminated against employees of the former Cannelton mine when Massey took over operation of the mine in 2004. The judge ruled that Massey erred in refusing to hire the miners "on the basis of their membership in the predecessor's bargaining unit and their pro-union sentiments."
