It seems pretty clear where the battle lines will be drawn when oral arguments take place between the EPA and utilities fighting to comply with the Cross-State Air Pollution Rule (CSAPR): flawed assumptions in the agency's modeling, opponents say, will be the hotly debated topic. Utilities struggling to chart a path toward compliance continue to claim the EPA's method of determining the proposed limits of its more stringent rules for S02 and NOx emissions is unrealistic. Hearings to take place in April of this year could get pretty intense as opponents of the regulation state their cases.
