SCOTUS reverses West Virginia Supremes, sends Harmon case back to Circuit Court

The U.S. Supreme Court has determined by a 5-4 vote that the West Virginia Supreme Court must revisit its 2008 ruling that reversed a 2002 verdict by the Circuit Court in Boone County to award from Massey Energy 50 million dollars to Harman Mining and its president, Hugh Caperton. The U.S. Supremes determined that Justice Brent Benjamin of the West Virginia Supreme Court should have recused himself from the appeal because Massey CEO Don Blankenship spent 3 million dollars to help get him elected to the court.
