Criminal Liability for False Accusations of Patent Infringement

If a warning letter that falsely accuses a party of patent infringement is circulated to the customers of the accused infringer or is posted over the internet, the sender of the warning letter or the one who has posted such information over the internet may be prosecuted under the Korean Criminal Code ("KCC") for wrongful business interference, and defamation or injury to the business reputation of the accused party.
