A new proposal for amending the Korean Trademark Act ("KTA") has been prepared by the Korean Intellectual Property Office to effectuate two important changes. First, the removal of the prior registration status of a cancelled mark with respect to a pending trademark application filed by the party who has caused the cancellation. Second, the clarification on the reach of a registered trademark right against a third party's use thereof in a trade name.
