Product marketing has developed in a way that consumers not only use names, logos and slogans to identify brands, but also shapes, colours, sounds and smells. Three-dimensional shapes pose a unique problem in that in many cases, the shape can be registered either as a trade mark or an industrial design (also known as "registered design" or "design patent" in some jurisdictions) .
