Korea Releases Proposed Changes to Unfair Competition Prevention Act

Draft amendments to the Unfair Competition Prevention and Trade Secret Protection Act (UCPA) were announced by the Ministry of Trade, Industry and Energy on August 18, 2016. The amendments seek to: (ⅰ) ease the requirement of exercising reasonable effort to maintain the confidentiality of a trade secret, (ⅱ) heighten the civil and criminal remedies and (ⅲ) penalize the act of copying the appearance of another person's product.
