The Transfer of Undertakings (Protection of Employment) Regulations 2006 ('the Regulations'or'TUPE') are designed to protect the rights of employees when a new employer takes over the business or the service contract for the purposes of which they are employed. The Regulations implement the European Acquired Rights Directive ('the Directive') in the UK, whose underlying purpose is to safeguardrnemployees' existing rights.rnTUPE has a reputation for being a very complicated and confusing area of employment law. However, the underlying ideas behind TUPE are quite simple.rnWhere there is a'relevant transfer', employees assigned to the transferred business become employees of the new employer following the transfer, as if they always had been. This means they have their continuity of employment preserved, and they are transferred on their existing contractual terms and conditions.
