The U.S. Environmental Protection Agency's emissions legislation marches on with more Tier 4 engines entering the market over the past year. All diesel engines with ratings above 804 hp will have to be Tier 4 by 2017. (Tier 4 applies to diesels with a horsepower rating of 804 and above. The latest rating is designed to reduce particulate matter by 90% and nitrogen matter by 80% compared to Tier 2 engines.) So not all 804-hp engines have to be compliant concurrently.
