District Court Judge Sets Anadarko Gulf Oil Spill Penalty At $159 Million

A federal judge has determined that energy company Anadarko should be assessed a Clean Water Act (CWA) civil penalty of $159.5 million for the Deepwater Horizon oil spill - a fraction of the $3.5 billion maximum penalty the company faced but which the judge says appropriately balances the company's lack of culpability and the extreme seriousness of the spill. In a Nov. 30 finding, Judge Carl Barbier of the U.S. District Court for the Eastern District of Louisiana analyzed eight factors, as required by the CWA, to determine Anadarko's actual penalty, using the "top-down" method by starting with the maximum penalty and considering factors that reduced that figure.
