EPA Denies Environmentalists' Novel Petition For GHG Rules Under TSCA

EPA is formally denying a petition from the Center for Biological Diversity (CBD) seeking to regulate carbon dioxide under the Toxic Substances Control Act (TSCA), a move the group argued was necessary to limit ocean acidification caused by higher carbon dioxide (CO2) concentrations in the atmosphere. In a notice signed Sept. 25 but not yet published in the Federal Register, EPA "acknowledged the impacts of CO2 and other greenhouse gases on ocean acidification and the potential impacts of ocean acidification on marine ecosystems in its 2009 [GHG] endangerment finding."
