District Court Dismisses Environmentalists' FOIA Suit Over EPA Utility ELG

A U.S. District Court for the District of Columbia judge has rejected the remaining claims in environmentalists' Freedom of Information Act (FOIA) suit trying to force release of documents that the Small Business Administration (SBA) gave to the White House during its review of EPA's pending power plant effluent rule. In an Aug. 28 order, Judge Christopher Cooper grants summary judgment for SBA on a number of remaining claims in the suit after earlier this month upholding the White House Office of Management & Budget's (OMB) claim that other documents sought are privileged and protected from disclosure.
