Environmentalists Cite Water Law, Air Act Cases To Fight Utility ELG Delay

Environmentalists are urging a federal district judge to preserve their suit over EPA's delay of an Qbama-era effluent rule for power plants by arguing the Clean Water Act (CWA) allows district court cases over suspension of water rules, while citing two high-profile Clean Air Act (CAA) cases to undermine the agency's basis for the stay. The plaintiffs in Clean Water Action, et al., v. Pruitt, et al., filed an Aug. 28 brief with the U.S. Court of Appeals for the District of Columbia Circuit opposing bids by EPA and the power sector to either dismiss the case, rule for EPA on the merits of the case, transfer the case to the U.S. Court of Appeals for the 5th Circuit, or hold the litigation in abeyance indefinitely.
