Federal District Courts Rule on Federal Regulatory Authority Over Rivers in Alaska

In two separate cases, U.S. District Court judges have held that the National Park Service (NPS) was not deprived of jurisdiction to manage the surface of navigable rivers flowing through NPS units in Alaska by application of a specific provision of the Alaska National Interest Lands Conservation Act (ANILCA), Pub. L. No. 96-487, 94 Stat. 2371 (1980). One of these cases was civil, the other criminal; both are now on appeal to the U.S. Court of Appeals for the Ninth Circuit.
