Civil words-evolving practices in dispute resolution at Engineers Ireland

Engineers Ireland has been involved in dispute resolution for over fifty years and the publication of the first edition of the (Irish) Conditions of Contract for Civil Engineering Work in 1959. This was a replica (with minor amendments) of the first edition of the conditions of contract published by the Institution of Civil Engineers (ICE) in the United Kingdom in 1945 (which itself was the basis for the first edition of the International Federation of Consulting Engineers (FIDIC) forms in 1957). Clause 68 provided for the settlement of disputes by arbitration with the arbitrator to be appointed by the President of the Institution of Civil Engineers of Ireland where the parties could not agree. 1. Evolution of dispute resolution The second edition of the Irish Conditions of Contract, published in 1967, was adopted jointly by the ICEI, the Association of Consulting Engineers of Ireland (ACEI) and the Civil Engineering Contractors Association (CECA). A third edition was published in 1980 based on the 1973 ICE fifth edition except that now IEI had taken the place of ICEI. The third edition of the IEI Conditions, as it was commonly referred to, was revised and reprinted in 1990 and it was subse- quently reprinted in January 2002. A fourth edition of what was now formally entitled 'IEI Conditions of Contract for works of Civil Engineering Construction' was produced in 1995 and reprinted in 1998, and again it was sponsored by the IEI, the ACEI and CECA.
