This year saw some incredible awards of damages for ACPA claims and saw courts react negatively to registrars acting as registrants of infringing domain names. As trademark holders seek to protect their brands online, they may turn to the ACPA or the UDRP for relief. Both the ACPA, with its hefty damages awards, and the UDRP, under which panelists are looking for ways to make equitable find-ings for complainants, appear ripe for injured parties seeking relief.
