FCC GRANTS ACS FORBEARANCE REQUEST

The FCC late Thurs. granted ACS' forbearance petition, with conditions. The company asked the FCC to forbear from applying regulations, including UNE sharing obligations, in the Anchorage area. The FCC said it based its decision on the fact that a competitor, General Communication Inc. (GCI), had made "substantial infrastructure investment" in the area. ACS was given relief from unbundling and pricing requirements in 5 of 11 wire centers "where the level of facilities-based competition by GCI ensures that market forces will protect the interests of consumers," the FCC said.
