Judge Lets La. Municipal System Take Complaint Against Cable Coop to FCC

The Lafayette Utilities System (LUS) won a legal battle against the National Cable Television nCooperative, of Kansas. U.S. District Judge Kathryn Vratil in Kansas tossed out a lawsuit nfiled by the coop to block LUS Fiber from appealing to the FCC the group's denial of nmembership to the provider. Membership would allow it to negotiate discounts in content nagreements. LUS Fiber had said in an earlier lawsuit in the court that coop member Cox nCommunications used its influence to keep LUS out of the group. Cox denied the nallegations. The NCTC later filed a countersuit against LUS to prevent its complaint from nbeing heard by the FCC. But Vratil ruled that the commission, not a federal judge, should ndecide the matter. .
