The sailing vessel did not meet the definition of "not under command", as any inability to manoeuvre was not through exceptional circumstances. As the event proved, by starting the engine the vessel was able to manoeuvre as required by the rules. The status of NUC does not apply just because a vessel's engine is shut down. Had the engine failed it would have been another matter.
