If a company is acquitted in a health and safety prosecution it can then apply to the court for its costs of defending to be repaid. Usually, the judge will award costs from Central Funds, i.e. the State will pay. A company will not recover all of its costs, but can expect to receive a significant proportion. However, all this is about to change.rnIn November 2008 the Ministry of Justice issued a consultation paper entitled The Award of Costs from Central Funds in Criminal Cases. The paper set out the Government's proposals for reforming the way costs from Central Funds are awarded in the defence of privately-funded defendants acquitted in criminal cases in England and Wales.
