The HSE is prosecuting a leading public-health advisory body, headed up by the regulator's former deputy chief executive, over a health and safety breach. The Health Protection Agency, whose chief executive Justin McCracken joined from the HSE in 2008, has been charged with breaching s2 of the HSWA 1974. It follows an incident in October 2007 at the Agency's Centre for Infections in Colindale, north London. The incident exposed three employees to the risk ofrninfection from E. coli 0157, after some material contaminated with the bacteria was spilt on the floor during disposal, though no one fell ill. An initial court hearing has been set for 5 February 2010 at the City of London Magistrates' Court.
