Paragraph 6 of the Criminal Injuries Compensation Scheme 2001 provides: "Compensation may be paid in accordance with this Scheme: (a) to an applicant who has sustained a criminal injury on or after 1 August 1964; (b) where the victim of a criminal injury sustained on or after 1 August 1964 has since died, to an applicant who is a qualifying claimant for the purposes of para.38 (compensation in fatal cases). For the purposes of this Scheme, 'applicant' means any person for whose benefit an application for compensation is made, even where it is made on his behalf by another person."
