Last month, Andy Mather wrote about one way in which the latest City Inn v Shepherd Construction decision impacted upon how architects should administer building contracts. That decision has also thrown into doubt the way in which many architects and lawyers approach extension of time claims. That approach depends upon the wording of the particular building contract. However, most building contracts provide for the contractor to be awarded an extension of time if: 1. a relevant event (late issue of instructions, for example) has occurred; 2. that relevant event has caused a delay in the completion of the works.
