On May 20, South West Trains introduced Super Off-Peak late-morning fares costing around 20% more than discounted fares which had previously applied to trains arriving in London after 10.00 on weekdays (RB1291 p4). Arriva Trains Wales and First Great Western have also recently raised some unregulated fares substantially. When Passenger Focus asked ORR to treat these increases as infringements of the Competition Act, ORR declined on the grounds that 'the cases are insufficiently promising to justify opening an investigation under competition law'. However, ORR Chief Executive Bill Emery did write on May 29 to DfT Rail Director General Dr Mike Mitchell, saying 'we believe that government should set out clearly the objectives underpinning its current and proposed fares policy and explain why it is in the wider public interest, taking into account the desired balance between the funding provided by taxpayers and fare-payers'.
