Nevada appeals Yucca Mountain decision

On September 26, the state of Nevada petitioned the U.S. Court of Appeals for the District of Columbia for a rehearing of the writ of mandamus case ordering the Nuclear Regulatory Commission to resume its review of the Yucca Mountain repository license application (RS, Sept.-Oct. 2013, p. 6). This time, however, the state has asked that the case be heard en bane, with all 10 of the circuit court judges presiding. The prevailing case, Aiken County, et at, was adjudicated by a three-judge panel, which issued its decision against the NRC on August 13.
