The case Walton Homes vs Staffordshire County Council considers what needs to be demonstrated to show a decision-maker has made a "manifest error" (08.10.13). Staffordshire council sold Walton Homes a former playing field for £107,000. The agreement provided for Walton to pay overage, stated to be the difference between two values determined within a month of planning permission being granted. These were the greater of £107,000 and the open market value of the property - assuming planning permission does not exist - and its open market value with planning permission.
