Dilapidations legislation met with trepidation

Landlords and tenants that fail to comply with regulations governing claims made for damages at the end of a tenancy could be prosecuted, after the rules were formally adopted by courts this month. On 1 January, the revised dilapidations protocol drafted by the Property Litigation Association in October became a formal "pre-action protocol" under Civil Procedure Rules. Rather than being a voluntary set of guidelines, as they were before, its recommendations are now legally enforceable.
