In "Mitigating Circumstances" (August 2009 Progressive Railroading, page 18), it struck me that there was a contradiction between your commending CN for endeavoring to meet the concerns of the communities affected by its acquisition of the EJ&E and your seeming indifference to the railroads' construction of the three intermodal facilities.rnIn order to acquire the EJ&E, CN had to secure the STB's approval. The Dec. 24, 2008, decision authorizing the acquisition imposed 104 voluntarily conditions and 74 agency imposed conditions. Yet 33 communities continued to believe that not enough had been done to protect their interests.
