At FERC's request, DC Circuit remands ISO-NE fuel security rules

At the request of the US Federal Energy Regulatory Commission, a federal appeals court has remanded back to the agency a case involving ISO New England's winter fuel security program to allow the agency to rule on the proceeding now that it has a quorum. The U.S. Court of Appeals for the District of Columbia Circuit on April 21 remanded the case back to FERC "for further proceedings." The commission on April 14 asked the court to give FERC another chance to rule on ISO-NE's proposed tariff revision to compensate energy resources for maintaining fuel or other forms of potential energy available over the winter months of 2023-2024 and the following winter season.
