It is still difficult to identify clearly what the upshot is of the Supreme Court's recent ruling that the Environmental Protection Agency has the power to regulate carbon dioxide emissions. But it is apparent that lower-court actions on the subject may have gotten a strong injection of energy, and one former key EPA official believes the agency will now have to make a formal determination whether to regulate CO2 emissions from power plants and other sources.
