Interfaith Community Organization and Hackensack Riverkeeper contended on March 14 that offers of judgment for attorneys' fees in two environmental citizen suits would modify the citizens' enforcement rights in violation of 28 U.S.C. 2072 and Congress' intent in enacting the citizen suit provisions of RCRA. (See issue of Feb. 28,. 2011 P. 9.) Honeywell International Inc. has argued that Honeywell should be able to make new offers of judgment for attorneys' fees and costs in two cases against Honeywell arising from chromium contamination on adjacent properties in Jersey City, New Jersey. The case is in federal court for the District of New Jersey.
