American Farm Bureau Federation and Pennsylvania Farm Bureau contended on Jan.10 the U.S. Environmental Protection Agency circumvented the normal process in promulgating the Final Chesapeake Bay Total Maximum Daily Load (TMDL) for nitrogen, phosphorus and sediment for Pennsylvania, New Jersey and other states in EPA Regions II and III.rnThe lawsuit filed in federal court for the Middle District of Pennsylvania says regional administrators assigned on Dec. 29, 2010 pollutant loads setting the final TMDL in excess of statutory jurisdiction, authority, or limitations and without following the Clean Water Act procedures.
