In a reply brief, the American Farm Bureau Federation told the Third Circuit U.S. Court of Appeals on Aug. 20 that Congress gave the U.S. Environmental Protection Agency no authority to substitute its preferences if it dislikes those of the states regarding a final Total Maximum Daily Load (TMDL) for nitrogen, phosphorus, and sediment for the Chesapeake Bay.
