In a proposed amici curiae brief filed out of time, 39 bipartisan members of Congress and the Washington Legal Foundation asked the Third Circuit U.S. Court of Appeals on June 20 to reverse a decision which held that the U.S. Environmental Protection Agency has authority to issue a Final TMDL (total maximum daily load) for nitrogen, phosphorus, and sediment for the Chesapeake Bay not only to the tidal states, but to the upstream states as well.
