Citizens Coal Council contended on March 21 that no waiver of attorney-client privilege occurs for communcations by persons seeking to be represented by the same attorney in its lawsuit with respect to litigation brought by LaBelle residents to redess pollution. (See issue of March 15,2014 Pages 5 and 14.) Matt Canestrale Contracting Inc. (MCC), owner of the LaBelle Refuse Site in Luzerne Township, Fayette County, is asking the federal court for the Western District of Pennsylvania to deny Citizens Coal Council's request in find that sharing communications subject to attorney-client privilege with co-clients or other attorneys did not waive the privilege.
