Pechiney Plastic Packaging and Rio Tinto AUM agree to $12 million and $26 million performance guarantees

The United States lodged on Jan. 13 a consent decree with Pechiney Plastic Packaging Inc., the primary settling defendant, and Rio Tinto AUM in which each agree to provide performance guarantees of $12,848,918 and $26,115,350 for remedial action at the Pohatcong Valley Groundwater Contamination Superfund Site in Warren County, New Jersey. The case is in federal court for the District of New Jersey. The remedial work consists of two operable units in the Kittatinny Limestone Aquifer, which serves as the source of potable water for private municipal wells in the Pohatcong Valley in portions of Franklin Township, Washington Township and Washington Borough. The site is 10 miles long by 1.5-miles wide.
