Patent Settlement Agreements

Patent litigation is often settled by agreement before the case goes to trial. The terms and conditions of settlement vary considerably, as each agreement reflects a reluctant compromise of opposing view points, coupled with the idiosyncrasies of each party to the litigation. Not surprisingly, there are very few published works discussing the general problems involved in negotiating or preparing a patent settlement agreement.
