Underwriters Laboratory is sticking to its guns. Officials with the Chicago-based standards group continue to say that it will "support" the sale of up to 15% ethanol fuel through "legacy" dispensers if fire marshals and other code authorities approve, as exclusively reported (OE 02/23/09). But can marketers take UL's "support" to court if they are sued for selling a 15% blend through dispensers that UL has officially certified for an E10 fuel only? It's a question that UL won't address directly. "The announcement is what it is," UL's manager of consumer affairs John Drengenberg told Oil Express this week. "It is not UL's role to determine the impact of this announcement with respect to state law and local fire marshals."
