In brief: Marketers won broader HOS waiver

Gas stations requiring emergency fuel deliveries and petroleum wholesalers short of drivers are now covered by the national Hours of Service waiver designed to ease the COVID-19 health emergency. Industry trade groups had asked the Federal Motor Carrier Safety Administration (FMCSA) to broaden the declaration’s list of emergency goods to fuel in the wake of a commercial driver shortage that has led to sporadic fuel shortages in some regions over the summer. In extending the HOS waiver to Nov. 30, the FMCSA also expanded the emergency declaration to other goods, including gasoline, diesel, jet fuel and ethyl alcohol. But the HOS waiver applies to narrow circumstances, not routine deliveries.
