Ethanol industry groups have asked the full U.S. Circuit Court of Appeals for the District of Columbia to review a three-judge panel's July ruling that overturned a June 2019 U.S. Environmental Protection Agency rule that lifted restrictions on the summertime sale of E15. The ruling found EPA exceeded its authority when it granted a Reid Vapor Pressure (RVP) waiver to the higher ethanol blend, saying the decision conflicts with language in the Clean Air Act that provides such a waiver only to E10. Without a waiver, E15 sales in many parts of the country are prohibited from June 1 through Sept. 15, the heart of the high-demand summer driving season.
