Labor: DOL clarifies when truckers are indie contractors

A U.S. Department of Labor (DOL) opinion letter(FLSA2021-9) issued Tuesday addresses when tractor-trailertrucker drivers are considered independent contractorsversus employees under the Fair Labor Standards Act (FLSA).As previously reported, labor lawyers have said that transportationcompanies, including fuel distributors, that work withowner-operator commercial truck drivers must be careful thatthese drivers meet the standard for being classified as independentcontractors or these firms could be liable for overtime,unreimbursed business expenses and other wage violations.
